The Federal Constitutional Court's climate protection decision has opened the law's perspective on climate protection. With the focus of the Federal Constitutional Court, the architecture of national climate protection law is still inadequate. This applies both to the federal level and, even more so, to the level of the federal states. Readjustments or, in some federal states, first-time adoption of state climate protection laws are necessary. In addition to the establishment of sufficient legal foundations, it is already apparent that the adequate implementation of climate protection law will be one of the major disputes of this decade. The first disputes have begun, others will follow.

This article highlights the practical relevance of the question whether the power of German administrative courts to enforce their decisions is limited to mere symbolism. The article argues that German administrative courts are stronger than commonly assumed if only the already existing legal instruments were utilized. Following the background of the will of the German legislator and the requirements of the European Law as recently laid out by the European Court of Justice (ECJ) in the case Deutsche Umwelthilfe e.V./Freistaat Bayern (C-752/18), German administrative enforcement law has much more to offer than just decorative value.

Legal remedies under the Aarhus Convention have still not been adequately transposed into German law. As long as this has not happened, the Convention will continue to have the function of directly broadening the scope of legal protection. With the ruling of the European Court of Justice of 20 December 2017 in the case “Protect”, the legal basis has been laid for closing the existing gaps in German procedural law.
