Pflichten zum Rückbau von Stromtrassen zu stillgelegten Kraftwerken
In the course of the so-called nuclear phase-out, all German nuclear power plants are successively shut down. According to the German „Energiewende“, many coal-fired power plants must follow. Therefore the question arises, what will happen to the power supply lines connecting those power stations to the national power grid. The examination shows that there is – in the field of public law – no legal obligation to remove these lines. Furthermore, public authorities will, in most cases, not have the possibility to order a removal either. In concern of the lines connecting coal-fired power plants and permitted later than 2001, the legal options depend on the contents of the permit. After all, depending on whether the extent of inoperative, but not-removed power supply lines exceeds an untolerable scale, the legislator is asked to solve the problem.
