Fighting climate change and coping with its consequences is a common challenge for Austria and Germany being neighbouring federal states and parties to the Paris Agreement. In this context, the reduction of greenhouse gases (mitigation) and adjustment to the consequences of climate change (adaptation) play an equally important role. In this contribution, therefore both norms, pertaining to the field of mitigation as well as adaptation, will be analysed. Moreover, we will look into the constitutional as well as selected fields of the statutory legal framework (outside the emissions trading system) to be able to delimitate the new field of climate law.

Klimawandelgründe und Klimawandelfolgen lassen die Menschheit ihre Schicksalsgemeinschaft erkennen. Verstärkte Naturkatastrophen belegen die düsteren Vorhersagen der Wissenschaft. Weltweit kommt die Klimakrise in der Öffentlichkeit an. Auf den verschiedensten gesellschaftlichen Ebenen nimmt der Kampf gegen die treibhausgas-induzierte Erderwärmung an Fahrt auf. Ziel ist die Begrenzung auf 1,5 bis maximal 2 0C. Nach einer Phase erfolglosen Appellierens nutzen die Gesellschaften nun die Mittel der Gesetzgebung, um „fünf vor Zwölf“ das Ruder herumzureißen. Dies gibt Anlass, im Sinne des Klimaschutzes eine weitere Verbesserung des Rechtsrahmens zu evaluieren. Ein Blick nach Neuseeland als außereuropäischem Partnerstaat des Paris Abkommens zeigt zunächst die gesetzliche Verankerung vergleichbarer Instrumente. Im Detail werden jedoch Unterschiede deutlich. Der weltweit umfassendste Emissionshandel Neuseelands erweist sich als vergleichsweise komplex und teilweise schwer implementierbar. Im Vergleich zum europäischen System ist der Einfluss des neuseeländischen Expertenrats auf politische Entscheidungen in Klimafragen deutlich stärker ausgeprägt. Eine neuseeländische Besonderheit ist das Amt des Klimaschutzministers, das der Priorität und Komplexität der Materie in sehr vorteilhafter Weise entspricht. Durch die Gerichte sind vergleichbare Fragestellungen zu entscheiden. In diesem Rahmen stellt vorliegender Beitrag die rechtlichen Grundlagen zusammen und destilliert aus Gemeinsamkeiten wie Unterschieden schließlich eine Essenz überlegenswerter Optimierungsmöglichkeiten.

Increasingly upcoming natural disasters like floods or hurricanes are the result of climate warming. Therefore, climate protection has become a major goal and a complex task as well, due to its wide range of influencing factors including its global dimension. In the last decades much effort has been invested by setting up international contracts. On the German national level, climate protection has generated legislation showing a strong tendency from voluntary goals to legally binding obligations on the level of federal states and the federal government. The implementation at the municipal level lies mostly in the competence of the federal states. Setting up tasks to the municipalities by the federal government in this context is blocked by Article 84 section 1 sentence 7 of the German Constitution. The climate protection laws of the federal states diverge significantly in addressing the local authorities. Both, the federal states and the federal government create an encouragement through funding programmes for municipal climate protection concepts and investment measures. Despite the urgency of success in climate protection, a desirable obligation for measures at the municipal level has not yet been established.
