The purpose of the paper is to analyse the conditions under which EU law confers rights to individuals. On the basis of the case law of the European Court of Justice, the different situations and conditions will be developed. Particular attention will be lead on the recent ruling of the CJEU in C-243/15 (Lesoochranarske).
