Lärmschutz im Recht der Flughafengenehmigung

Protection against aircraft noise is not only a matter relevant in practice, but also in terms of legal doctrine. Though the German legislator has a special interest in noise control, this interest often collides with airline operations and society’s desire for mobility. In order to prevent health hazards or other damages to a new airport’s local residents already in advance, the planning phase should comprise a responsible use of all available legal means. Only this way, planners can increase the population’s approval of the airport and decrease the litigation risks.
