The conclusion of the Aarhus-Convention was a major step in international environmental law. The following contribution focuses on the relationship between the Aarhus-Convention and (existing) international environmental law and illustrates this special character of the Convention before dealing in detail with the legal effects of the Convention in the legal orders of the European Union and of Switzerland. Special attention is paid to the discussion of the relevant case law.

This article will set out possible reasons for the inadequate transposition of Directive 2002/49/EC relating to the assessment and management of environmental noise into German law, which gave rise to formal infringement proceedings against Germany. It thoroughly analyses the process of implementing the requirements of the Directive into national law and explains the difficulties resulting from the discretion granted to national legislators, in particular with regard to the introduction of noise action plans.

The purpose of the paper – tied in with the case law overview for the year 2015 – is to provide an overview of the environmental case law of the European Court of Justice for the year 2016. The objective is not to cover the entire case law but to highlight selected decisions deemed by the author to be of importance, with reference to some additional rulings in the footnotes. The focus is on summarising the latest developments and, where appropriate, briefly commenting on or placing the decisions in the context of existing case law. The author largely forgoes further reference to bibliographic sources.
