Nearly three years ago the Circular Economy Act (KrWG) entered into force. Since then there have been several legal disputes before Administrative Courts between commercial collectors and the public body responsible for waste management (öffentlich-rechtlicher Entsorgungsträger), especially concerning the notification procedure for collections (Section 18) and voluntary acceptance of returned goods (Section 26). This article scrutinises recent court decisions regarding the prohibition of commercial collectors for various reasons such as unreliability of the collector, missing or unclear statement of the proper and safe recovery of the collected waste and the principle of overriding public interests. The study of the case law elucidates that there is still a notable difference between the legal reasoning of courts in the federal states. Furthermore, the article outlines the impact of these judgements to the public body responsible for waste management and their concern of a broad interpretation of product responsibility. Finally, the author concludes that harmonization can only be achieved through a soon to be expected decision by the Federal Administrative Court.
