Das Insektenschutzgesetz 2021

On August 30, 2021, the Act on the Protection of Insect Diversity in Germany and on the Amendment of Other Provisions („Insektenschutzgesetz“) was promulgated in the Federal Law Gazette. The Act is one of the key building blocks for implementing the “Action Programme for Insect Protection” adopted by the German government in 2019 at the suggestion of the Federal Ministry of Environment. It mainly includes amendments to the Federal Nature Conservation Act (Bundesnaturschutzgesetz) and, in addition, both an amendment to the Compensation Act (Ausgleichsleistungsgesetz) and the Plant Protection Act (Pflanzenschutzgesetz). In context of this article, the numerous new regulations in the Federal Nature Conservation Act are with respect to insect protection critically examined regarding their efficacy, promotability and effectiveness furthermore, if necessary, improvements are pointed out.
