The example of the regulation of Carbon Capture and Storage (CCS) shows that the climate policy goals of the Commission and the German government are at odds with the current relationship between prohibition and incentives. The interplay of instrument mix and decision shifting in the European multi-level system proves to be partly unsuitable to solve the regulatory challenges. With regard to CCS, the relationship between climate protection law instruments therefore does not allow for the “moon landing” envisaged by Ursula von der Leyen through the European Green Deal in climate protection law.
