Das EU-Klimagesetz im Lichte von Demokratie- und Effektivitätsprinzip

The European Union intends to play a game changing role in the fight against climate change. Within its “European Green Deal” the EU aims at transforming into a modern, resource-efficient, and competitive economy and plans Europe to become the first climate-neutral continent worldwide by the year 2050. According to the European Commission, the so called “European Climate Law” is the heart of this political concept, which, for the first time, states the European Climate Action Goals in a legally binding way. The following article analyses whether the European Climate Law fulfils democratic requirements and whether it really is the game changing, effective instrument ensuring that the EU will achieve its Climate Action Goals.

Der Beitrag enthält die Ausarbeitung eines Vortrags, den die Autorin im Rahmen des XI. Internationalen Förder-Kongresses „Junge Wissenschaft und Wirtschaft“ der Hanns Martin Schleyer-Stiftung, „Europa im Aufbruch? – Neue Impulse für Freiheit und Wohlstand in einer sich verändernden Weltordnung“ im Juni 2022 gehalten hat.
