In a first section, the article examines the question of whether and to what extent the ruling of the Federal Constitutional Court of May 5, 2020 is compatible with applicable EU law. It comes to the conclusion that this is not the case, but that Germany has not entered a reservation against the unrestricted primacy of EU law. A second section deals with the question of whether the ruling of the Federal Constitutional Court and the ruling of the Polish Constitutional Court are comparable.
