Staatshaftung für Hochwasserschäden

Foroud Shirvani

Flood events can have a destructive force and cause considerable damage to people and the environment. If properties and houses are damaged as a result of flooding, the question may arise as to whether the public authorities are liable for the damage caused because they acted incorrectly in the area of flood protection. In this context, German public liability law defines the conditions for the liability of public authorities for flood damage and determines the legal consequences. This article discusses some groups of cases under public liability law that have been the focus of the case law of the German civil courts.
