The German Animal Welfare Act (GAWA) defines the status of animal welfare by confirming the animals‘ moral standing (section 1 sentence 1). The GAWA states that killing of animals is permitted only if rationally justified („vernünftiger Grund“) (Section 1 sentence 2). The customary legal interpretation neglects the ethical claim of GAWA proclaiming justifications reasonable even if they only serve social and commercial interests tacitly ignoring other considerations, including those of moral standing. This article examines the current GAWA interpretation and argues for strict and obligatory adherence to the principle of proportionality (Verhältnismäßigkeitsprüfung). Furthermore, the Federal Administrative Court of Germany has decided, that killing of male chicken is rationally justified until the technique of in-ovo sex determination becomes commercially available. This article disagrees with this interpretation and argues, that economic profit alone does not represent sufficient rational reason.
