In the recent past several cases of executive disobedience have raised doubt as to whether German administrative courts have the necessary means to enforce their decisions against the executive. This article examines this question, taking into consideration constitutional aspects and European Union law, and highlights the fact that German law – contrary to popular belief – offers several not yet tested possibilities to enforce decisions against the executive.
