The MgvG (Maßnahmengesetzvorbereitungsgesetz) stipulates the possibility to approve enumerated transport infrastructure projects by an Act of Parliament if certain conditions are fulfilled. Given the different legal protection with regard to Acts of parliament on one side and administrative acts on the other, it is questionable if the MgvG is compatible with the requirements of international and European law as well as constitutional law regarding legal protection. Furthermore, it could violate the principle of the separation of powers.
