Lately, the rules on state aid and public procurement gained significant importance in energy transition. Both, the advancement of renewable energy and increasing energy efficiency are carried out in the framework of EU state aid regulation which is heavily shaped by the commission. While public procurement law doesn’t specifically mention the topic of renewable energy it does allow for the procurement of such services. At the same time, it heavily regulates the energy efficiency of procurements. Therefore, those contracting authorities, covered by the public procurement regulations, are, at varying degrees, bound to factor in the energy efficiency of a product.
