Bedeutung des Klimaschutzgesetzes bei Abwägungsentscheidungen in der Bauleitplanung
The provisions on urban land-use planning laid down in the Federal Building Code (BauGB) only allow limited additional legislation of the Länder in respect of climate protection. The federal legislator has decided against a normative precedence of climate issues. This should exclude weighting requirements imposed by Land law. However, climate protection goals of the Länder can emphasize the importance of climate change issues and thus improve their consideration by the planning municipalities. Furthermore, climate protection goals under Land law develop a significant importance especially in the interpretation of undefined legal terms. This is the case when it comes to issue an exemption on the grounds of the public good. Also, climate protection goals must be considered as a public interest in the approval of projects in the undesignated outlying area.
