The General Court assessed that the EEG 2012 involves state aids. The latest judgement is in line with a series of various court decisions, all of them expanding the European term of state aid. This article explains the relevance of the ‘control’ criterion in the state aid jurisprudence and criticizes the extensive interpretation of Art. 107 I TFEU.
