The most recent ruling of the EU General Court on the specific mechanism to fund renewable energies in Germany provides interesting hindsight into the refinement of the criterion of State resources as one of the five requirements for the existence of a State aid pursuant to Article 107 (1) TFEU. Even outside the specific regulatory context it originates from this judgment carries therefore a much wider impact for State aid law in general.
