The following article analyses and summarizes the main aspects of the judgment of the European Court of Justice of 14 January 2016 in case C-399/14 (request for a preliminary ruling under article 267 TFEU from the German Federal Administrative Court). The judgment deals with the scope as well as the substantive requirements of Article 6 (2) of Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora („the Habitats Directive“). The article concludes that the respective judgment will on the one hand certainly strengthen the protection of habitats by EU law but might on the other hand finally undermine the importance of the legal institution of immediate enforceability provided by national administrative procedural law in the scope of Article 6 (2)-(4) of the Habitats Directive.
