After the adoption of harmonisation measures with the aim of establishing or ensuring the functioning of the internal market, the member states are authorised to maintain their current provisions by the „opting-out-clause“ pursuant to Article 114(4) TFEU. The denial of this right by the Commission towards the Republic of Germany, concerning the maintaining of limit values for heavy metals in toys, is the subject of the decision of the General Court in May 2014. The General Court largely upholds the Commission's decision and raises questions as to the legal standard of proof, in particular relating to the precautionary principle.
