In the aftermath of the nuclear accident in Fukushima (Japan) the German Federal Government decided to phase nuclear power out in Germany. Before correlating legislation entered into force, the Federal Government officially (and hastily) proclaimed a moratorium for nuclear power plants and directed, inter alia, the government of Hesse to shut down the older nuclear
