I. Introduction The Environmental Liability Directive (“ELD”)1 was fully transposed into United Kingdom (“UK”) law on 24 July 2009 after a lengthy consultation process. The transposition of the ELD marks a dramatic change in UK environmental law because it is the first European Union (“EU”) polluter-pays law.2 By introducing environmental liability legislation at the EU level, EU law now supplements traditional domestic environmental liability law that has
